I was relieved to see this on WRAL's website. The paper was printed before they were arrested.

What a horrible thing to happen in a place where everyone just wants to have a good time. Makes you realize there is no point in getting into an argument with anyone about anything...

Brothers In Custody Following Double Fatal Shooting
Two Illinois Men Shot At NCSU Tailgating Party
POSTED: 7:23 PM EDT September 4, 2004
UPDATED: 11:57 AM EDT September 5, 2004

RALEIGH, N.C. -- A North Carolina State University student and his brother are in custody, charged in the shooting deaths of two men at a tailgating party across from Carter-Finley Stadium Saturday.

Timothy Johnson, 22, a student at N.C. State, and his brother, Tony, 20, both of Raleigh, are each charged with two counts of first-degree murder.

Timothy Johnson was arrested at 11:55 p.m. on Harden Road in Raleigh. Tony Johnson was arrested in Wilson at 1:09 a.m. Sunday after surrendering to Wake County Sheriff Donnie Harrison.

The Sheriff's Office said the shooting happened in a parking lot at Trinity Road and Youth Center Drive at about 6:20 p.m.

Kevin McCann, 23, of Chicago, Ill., died at the scene. 2nd Lt. Brett Harmon, 23, a Marine from Park Ridge, Ill., died at WakeMed.

One victim was shot in the head, the other in the neck according to authorities. Harrison said neither were N.C. State students.

Officals searched for the brothers who, according to witnesses, left the scene in a dark green Chrysler Cirrus.

Harrison said the men were captured thanks to the help of the following agencies: the Raleigh Police Department; the United States Marshal; the state Highway Patrol; NCSU Campus Police; the North Carolina State Fair Security and the State Capitol Police.

Authorities are trying to determine if a fight led to the shooting.

Witnesses, including Tommy Rodwell, said a fight took place about an hour before the shooting.

"We were standing there and this girl came up. She was covered, splattered by blood because their friend had just been shot," Samantha Mitchell said.

The shooting happened after the North Carolina State Wolfpack kicked off its season home opener against the Richmond Spiders.

Anyone with information is asked to contact the Wake County Sheriff's Office at (919) 856-6800.

Tailgate shooting leaves 2 dead
Two brothers, suspects in a fatal altercation outside the Pack game, are said to have fled in a green car

By LORENZO PEREZ AND TODD SILBERMAN, Staff Writers

RALEIGH -- Two men were fatally shot outside Carter-Finley Stadium Saturday night during N.C. State's football season opener, turning a popular tailgating stretch along Trinity Road into a chaotic crime scene for police investigators.

The victims, both 23, were identified as Kevin M. McCann of Chicago and Brett Johnson Harmon, a Marine from Park Ridge, Ill.

The Wake County Sheriff's Department has arrested two suspects: brothers Tony Harrell Johnson, 20, who was arrested in Wilson at 1:09 a.m. Sunday, and Timothy Wayne Johnson, 22, who was arrested on Harden Road in Raleigh at 11:55 p.m. Saturday night.

Sheriff's officials say Timothy Johnson is a student at NCSU. The two men have addresses in Raleigh, according to the sheriff's department.

The shootings forced the Wake County Sheriff's Office and Raleigh Police Department to cordon off entire rows of sport utility vehicles, pickups and trailers towing grills as investigators canvassed for witnesses within the crowded tailgating spot backing up to the State Fairgrounds complex.

Neither of the shooting victims was an NCSU student, Wake County Sheriff Donnie Harrison said.

He said the suspects fled in a dark green, four-door 1996 Chrysler Cirrus sedan with North Carolina license tag RSJ7522.

McCann died at the scene. Harmon died at WakeMed, Harrison said.

The shootings happened shortly after the 6 p.m. kickoff of game, which drew a sellout crowd of 55,600. Many of those parked along the fairgrounds complex were still tailgating when the shootings took place.

Tailgaters said it took awhile for police to respond because of traffic congestion in the area.

"Nothing against the police, they couldn't get here. There was too much traffic," said Jason Seaton, 32, of Apex.

As the game continued across the street, several tailgaters were cited for ignoring police warnings and crossing into the crime scene to reach their vehicles. Standing outside the crime-scene tape, others offered varying accounts of what prompted the shootings.

Witnesses told investigators a fight in the parking lot an hour before the game preceded the shootings.

Tommy Rodwell, a 21-year-old NCSU senior, remembered a green car speeding through the crowded tailgating area as several people yelled at the driver to slow down. The car stopped midway up one unpaved lane after someone had thrown a carton of beer cans at the car, and the driver got out.

"[The driver] took a swing at one guy and got knocked down, and then someone else kicked him," Rodwell said.

The driver got back in his car and sped out of the tailgating area. About an hour later, the car returned, witnesses said.

Seaton said he was standing less than 30 feet away when he saw two young men get out of a car and sidle up to a small group of tailgaters. Then he saw a puff of smoke and heard what he thought sounded like a series of bottle-rockets.

"It looked like a prank," Seaton said. "I saw the two guys, and they weren't sprinting out of there. They were all nonchalant jogging out of there."

Seaton said after he saw the two victims sprawled on the ground, he tried to staunch the bleeding from their wounds. It was too late for one. "I saw him gasp three times, and he was dead."

As the suspects jogged back into the State Fairgrounds complex, tailgaters said, 10 to 15 people chased but did not catch them.

By 9:30 p.m., investigators had reduced the crime scene to an area enclosing about 10 tailgaters' trucks and cars. With NCSU defeating the University of Richmond 42-0, fans started trickling out of the stadium midway through the second half.

Those who had cut their tailgating short to go into the game walked by wide-eyed as they learned two people had been shot near where they had parked.

"It's a sad case. People come here to have a good time," said Seaton, stroking his long goatee. "When I get out of here, when nobody's looking, I'm gonna cry about this."

You want some irony?

I've tossed both those goobers out of my place of employment before--the first one for having an ID that was so busted and faded that I couldn't read it, and the second for having a bogus ID.

Bah--when you've been shot at, stabbed, in car accidents, had brushes with the Black Death and bacterial meningitis, and had a bunch of other brushes with the Reaper, everything else is kinda meh.

But to answer your question, I work at a convenience store.

Will the brother (or did he already) get a plea bargain?

Will the brother (or did he already) get a plea bargain?

He got a plea bargain from what I remember.... don't remember the length of the sentence but much less than his brother that was the shooter.
